Not sure I have much to say, other than that it’s good news that the ACA has been upheld.

  1. Thank goodness 5 sane people prevailed on the court. It was obvious to any lawyer with a shred of grey matter that the individual mandate is constitutional under congress’ taxing power (which is basically unlimited) -- which is exactly what the majority ruled. even though a lot of people whined that the obama administration didn’t argue that the bill was valid under the taxing power (because they’re pussies), what such whiners forget is that the court can rule on the validity of a law based on any constitutional theory they want to (sua sponte). so kudos to the 5 sane people on the court (a group that thankfully includes chief justice roberts).

    • Justice Roberts basically said what I just said and almost went so far as to explicitly call out Scalia, Thomas, etc. as shameless partisan hacks:

In a section of his opinion joined by the liberal justices, Roberts noted that the conservative dissenters contend that the mandate cannot be upheld as a tax “because Congress did not ‘frame’ it as such. In effect, they contend that even if the Constitution permits Congress to do exactly what we interpret this statute to do, the law must be struck down because Congress used the wrong labels.”

      • But it is nice to see that the Tea Part fanatics and the corporate buy offs could not reach everyone. If this keeps up, and more people in government start doing what they are suppose to, rather than what they are bought to do, I just might start believing that the age of miracles is upon us.
